Superintendent Role Independent Certifier or Principals Agent

Understand the Superintendent’s dual role, decision-making authority, fair assessment duties, claims and certification processes, and governance requirements for defensible contract administration.
The same Superintendent can act as the Principal’s agent and as an independent assessor or certifier – but the function being performed determines the approach required. This session gives Superintendents, Contract Administrators, engineers and project professionals practical guidance on separating those functions, acting within delegated authority, and fairly assessing directions, payments, EOTs, variations and claims. You’ll learn to resist inappropriate commercial pressure, avoid over-direction, give clear reasons and build defensible decision records that support fair administration and reduce governance and dispute risk.

What You'll Learn

Know which hat you're wearing – distinguish Principal's agent functions from assessment and certification functions before making or communicating a decision

Don't substitute Principal preference for contractual entitlement – ground assessments in the contract, facts, evidence and reasoning

Treat fairness as a process – request the right information, consider relevant material and give clear reasons, rather than relying on a sense of what feels fair

Stay within authority – confirm the clause, delegation, approval thresholds and decision-making authority before acting

Separate instruction, entitlement and valuation – particularly when assessing variations, EOTs and contractor claims

Build the defensible record – preserve the contract basis, notice chronology, evidence, assessment notes, decision and approval trail

Identify the ten habits that separate defensible contract administration from exposed administration

Apply a simple check before issuing or responding to any notice

Spot early warning signs that a variation or delay claim is heading for dispute

Know exactly what to document — and when — to protect your position

Avoid the three most common mistakes that undermine a superintendent’s certification

Walk away with a one-page reference you can pin above your desk
