Superintendent Directions Helpful Tool or Dispute Trigger

Understand the authority, triggers, drafting, limits, entitlement impacts, and governance controls required for defensible contract directions.
Practical guidance on issuing clear, authorised and defensible contractual directions. Designed for Superintendents, Contract Administrators, engineers and project professionals, this session explains when formal directions should be used, what they should contain, and how poorly worded or informal instructions can unintentionally create variations, EOTs, acceleration costs and other claims. You’ll learn to distinguish directions from RFI responses and approvals, preserve the Contractor’s responsibility for work methods, assess commercial consequences before you issue, and keep an audit trail that reduces disputes.

What You'll Learn

Check authority before issuing a direction – identify the contract clause, delegation and approval pathway before acting

Direct the outcome, not the method – leave construction means, methods, sequencing, temporary works and workface management with the Contractor

Screen every direction for commercial impact – consider the effect on scope, time, cost, productivity, access, safety, design and risk before release

Keep directions, RFI responses and approvals distinct – loosely drafted clarifications or approvals can become contractual instructions or acceptance of responsibility

Control oral and informal instructions – confirm material conversations in writing promptly, recording what was and wasn't directed

Register, track and close out every direction – keep the authority, attachments, distribution, response, notice and decision trail needed for a defensible record

Identify the ten habits that separate defensible contract administration from exposed administration

Apply a simple check before issuing or responding to any notice

Spot early warning signs that a variation or delay claim is heading for dispute

Know exactly what to document — and when — to protect your position

Avoid the three most common mistakes that undermine a superintendent’s certification

Walk away with a one-page reference you can pin above your desk
